Repeat-infringer policy

Why this policy exists

Section 512(i) of the Digital Millennium Copyright Act requires a service provider to adopt, reasonably implement, and inform its users of a policy providing for the termination, in appropriate circumstances, of account holders who are repeat infringers. This page is that policy. It is adopted by WEHOZ INC, a California corporation, and it applies to every account on wehoz.com — seller accounts, which are subject to the strike system described below, and all other accounts, which are subject to the general rule in the last section.

It works together with our DMCA policy, which explains how to file a takedown notice and how the counter-notice process works, and with the Seller Agreement, which makes this policy binding on every seller (Section 11).

What counts as a strike

A strike is recorded against a seller account only when a DMCA takedown notice is reviewed by our team and upheld as valid— meaning the notice met the statutory requirements of 17 U.S.C. § 512(c)(3) and, on review, we removed the identified listing. One upheld notice equals one strike.

The following do not count as strikes:

  • A notice we receive but have not yet reviewed.
  • A notice we reject as invalid, deficient, or abusive.
  • Reports made through channels other than the DMCA process, unless they lead to an upheld DMCA notice.

What happens on each strike

  • The listing identified in the notice is removed from sale.
  • The strike is recorded on the seller account with the date it was issued.
  • The seller’s internal trust score is reduced, and the seller loses eligibility for automatic listing approval while strikes are on the account.
  • We notify the seller by email. The notification identifies the notice number, describes the action taken, and includes a personal link to file a counter-notice.

How strikes are counted

Strikes are not automatically removed and do not currently expire from an account. The Seller Agreement (Section 11) states the termination threshold as three valid notices within any twelve-month period; because strikes remain on the account, three valid notices within any twelve-month period always meets the threshold. If you believe a strike was recorded against your account in error, contact dmca@wehoz.com with the notice number.

Termination: the third strike

A seller account that accumulates three strikes is permanently terminated. Termination is executed by the platform without discretion and means:

  • Your selling privileges end permanently. You may not list, sell, or open a new seller account to continue selling.
  • Your account is marked suspended under the repeat-infringer policy and we notify you by email.
  • Orders already placed must still be fulfilled, and settled balances are released according to your contracted payout schedule.
  • Your obligations under the Seller Agreement — including indemnification — survive termination.

Counter-notices

If your listing was removed because of a mistake or misidentification, you have the right to file a counter-notice under 17 U.S.C. § 512(g). The takedown email we send you contains a personal link to the counter-notice form; the process, the statutory requirements, and the restoration timeline are described in our DMCA policy.

Filing a counter-notice does not automatically remove a strike. If a takedown is reversed following a valid counter-notice, contact dmca@wehoz.com to have the associated strike reviewed.

Reporting infringement

If you are a copyright owner — or a brand or other rightsholder authorized to act for one — and you believe a listing on Wehoz infringes your copyright, file a takedown notice as described in our DMCA policy. That is the process that produces the strikes described on this page.

False notices and false counter-notices

Knowingly making a material misrepresentation in a DMCA notice or counter-notice — that material is infringing, or that it was removed by mistake — can make you liable for damages, including costs and attorney fees, under 17 U.S.C. § 512(f). We may also reject future notices from complainants who abuse the process.

Accounts other than seller accounts

Buyers and other account holders can also post content on Wehoz — reviews, questions and answers, photos, and messages. Content that infringes copyright is removed under the same DMCA process, and we will terminate, in appropriate circumstances, any account that repeatedly posts infringing content.
